BUSINESS LITIGATION

ACM’s litigation group is comprised of highly experienced trial attorneys who handle complicated commercial and business disputes covering a myriad of business, real estate and entertainment issues on behalf of individuals, executives, entrepreneurs and business entities.

Among other things, ACM’s trial attorneys routinely provide strategic advice, litigate and participate in trials concerning securities/investor fraud, hospitality, employment, construction, business and personal torts, including, breaches of fiduciary duties, fraud, unfair business practices, defamation, intentional and negligent interference with contractual relations and prospective economic advantage, conversion, surety, HOA/CC&R, trust and probate matters, as well as, appellate and writ matters.  ACM’s trial attorneys also routinely handle inter-company and intra-company disputes including, disputes between investors, shareholders, directors and offices of corporations, disputes between investors, members and managers of limited liability companies and partners in partnerships. Such matters typically involve both contractual based disputes, as well as, business torts such as breaches of fiduciary duties. In addition, ACM’s trial attorneys have in-depth experience with procurement of provisional remedies, such as, obtaining and enforcing prejudgment writs of attachment, receiverships and injunctions and judgment collection procedures, and have further represented numerous creditors and judgment creditors in the United States Bankruptcy Courts and in adversary proceedings objecting to the discharge of debts owed to ACM’s clients.

In handling such matters, ACM’s trial attorneys often work closely with ACM’s corporate-transactional attorneys to help their corporate clients deal with costly and time-consuming commercial disputes, which, unfortunately, seem to arise with greater frequency in modern commercial settings.  Regardless of the situation, ACM’s trial attorneys, like other attorneys within the firm, stand ready and strive to offer personalized, practical, value-added, comprehensive, diligent and cost-effective legal counsel to help clients navigate the various stages of the litigation cycle, including trials, to achieve superior outcomes.

Partner, Christian S. Molnar, is ACM’s litigation team leader.
